DWI is described as operating any type of motor vehicle with an unlawful amount of alcohol (.08% AC or higher) in the person’s system. DWI charges are serious and can be filed for driving under the influence of substances other than alcohol. When a law enforcement official pulls someone over under suspicion of DWI, they must be able to prove that they believed the driver's mental or physical abilities were impaired due to drug or alcohol use.

Penalties for DWI Convictions

The penalties you may face for DWI vary depending on the circumstances of the crime and whether it was a first DWI offense. While anyone arrested with a blood alcohol concentration (BAC) of .08% or higher can be charged, there are other factors which may be considered. If there was an accident or any injuries involved in the crime, you could face increased punishments.

The penalties for DWI charges in New York may include:

  • First offense – Your first DWI arrest will likely be charged as a misdemeanor and punished with up to a year in jail, no less than 6 months of license suspension, and fines of $500-$1,000. You may also face court-mandated alcohol treatment.
  • Second offense – A second DWI arrest within 10 years will likely be charged with a felony. If convicted, you could face up to 4 years in prison, 1-year of mandatory license revocation, and between $1,000 and $5,000 in fines. An ignition interlock device may also be required.
  • Third offense – If you are arrested for a 3rd time within 10 years, you will face a felony charge that can be punished with $2,000 to 10,000 of fines, up to 7 years in jail, and a 1-year minimum license revocation.
