What Is Expungement?

In the past, there were only limited options available to keep a criminal record sealed and protected from view, leaving many people to deal with the consequences of their past. Recently, however, New York passed a law allowing for expungement allowing you to seal your record away from anyone except those with government access. While you may still have a criminal record, it will be virtually inaccessible to anyone except specific parties like parole officers or police. Potential employers or landlords will not receive information regarding arrests or convictions.

In order to be eligible for record sealing, you will need to meet these criteria:

  • You were charged but not convicted during the trial
  • You were convicted of a misdemeanor and completed a treatment program
  • You have no pending charges against you following a conviction
  • You have two or fewer convictions (and a maximum of one is a felony)
  • You were not convicted of an ineligible crime (listed below)

Certain crimes and convictions are eligible for sealing while others are not. These ineligible categories include most sex crimes, homicide, violent felonies, and Class A felonies.
